Our website facilitates an exciting and convenient way to buy and sell goods over the Internet and is operated by Jolly Antiques Ltd. (“the Company”). We provide an online facility vehicle through which traders can sell and customers can buy products (‘the Services’). It is important that you read and understand these terms before using the Services. By accessing or using the Services, you agree to be legally bound by these terms, as they may be modified from time to time.

We reserve the right to change these terms at any time. Amendments will take effect when posted on our website. However, the terms current as at the start of a particular transaction will apply until that transaction is completed.

7.Our role

Our website is a place for sellers to offer goods for sale and for customers to make offer to buy them. We do not have and never intend to have any contractual involvement in your transactions and at no stage auction, buy or sell or purport to auction, buy or sell any of the products displayed on our website. Any disputes between buyers and sellers are just that we will not become involved. You must therefore take the utmost care to screen the parties with whom you deal. We will not screen the parties or goods on your behalf and this is a feature of the relationship between you and us that you willingly accept.

12.3If you make an offer for an item listed on our website, you acknowledge and agree that if your offer is accepted by the seller, you have entered into a legally binding contract with the seller to buy that item. You can only terminate that contract in limited circumstances set out in law, for example where the item does not materially comply with the information provided in relation to it or where you cannot identify the seller. Sellers may refuse to accept your offer for whatever reason.

12.4With regard to returns and refunds, please read our Returns Policy. Your acceptance of these terms and conditions entitles us to assume you have read this Returns Policy.

12.5Returns Policy. An purchased item can be returned within 30 days from receiving it by the buyer. No reason needs to be provided. The return costs are the responsibility of the buyer except for the case when the item is not the one they’ve purchased or the description doesn’t match the item. The company will only cover return costs which are lower or equal with the initial shipping costs.

13.General rules governing listing and selling

Some items sold by sallyantiques.co.uk (‘the seller’) belong to a third party and in some occasions the item may prove to be unavailable in which case the seller will issue a full refund to the buyer.

14.Payment and shipping

14.1All buyers must pay sellers for items using seller’s the provided payment methods. Payments shall be received in the currency specified on the website and all prices are exclusive of VAT, and other applicable taxes, delivery charges and insurance.

14.2Buyers are responsible for any costs of delivery and any insurance costs which will be charged upon checkout or after if the default checkout costs don’t cover it. The buyer will be notified prior to shipping of such costs. If the buyer will not be able to pay the added costs, they can ask for an order cancelation and full refund, which will be automatically granted.

14.3Some transactions may involve sellers shipping items to buyers located outside the United Kingdom or outside the territory in which the seller resides. Buyers and sellers alike must observe and comply with all applicable regulations and legislation, including obtaining all necessary cultural or customs permits. Further, the importation and exportation of some items may be prohibited by certain national laws.

14.4All import duties are the responsibility of the buyer.

14.5If the buyer decides to refuse an item whilst in transit they have to wait for the delivery first. If they refuse to collect the parcel and or pay the duty they will not be refunded.

14.6All refund in the case of returns will be issued only after the item has been safely returned to the seller and in the same condition as it was when posted. If the item is damaged, altered or is missing parts the refund will be issued.

14.7The seller will accept a 10% non-refundable deposit to reserve any item in stock which will expire after a calendar month. After this period the item will go back on sale.

14.8The seller can accept a layaway payment for an item for a maximum of three calendar months if not agreed otherwise. If after the default three months the payment is not fully fulfilled, the amount already paid will not be refunded and the item remains the property of the seller.

15.Privacy policy

We take privacy issues seriously. Our current privacy policy covers our use of any information you provide. In using our Services you acknowledge and agree to be bound by the terms of our privacy policy.

16.Termination

The Company has in its sole and absolute discretion the right to issue a warning, temporary suspension, or an indefinite suspension and termination of your rights to use the website or our Services if you:

1. act inconsistently and in breach of these terms and conditions;
2. at any time violate or attempt to violate any rights of any other user of the Services or third party;
3. are engaged in any fraudulent activity; or
4. fail to make any payments due to us in accordance with these terms.

16.1Should you wish to terminate your account with us, you must indicate to us in writing 28 days before we can close your account.

16.2The account holder is responsible for unsubscribing themselves from our automated newsletter and emails, which will delete them permanently from any of these notifications.

17.Compliance with laws

You agree to comply with all applicable laws, statutes and regulations concerning your use of our website and the Services.

18.General release
